Sample Contract for Designer

Performing Arts Organization: [Organization Name]
Designer: [Designer Name]

This contract (“Agreement”) is made and entered into on the date of acceptance by the designer, and is by and between [Organization Name] (“Producer”), and [Designer Name] (“Designer”).

1. Engagement:
Producer hereby engages designer to render services as the [Design Role] for the theatre production of [Production Name] (“Production”). Designer shall be responsible for all [Design Role] aspects of the Production, including but not limited to [Design Deliverables].
2. Deliverables:
Designer shall be responsible for the following deliverables:
- Deliver a light/sound/stage design and execution plan to the artistic team of the theatre production
- Work with the artistic team to realize the overall design vision and goals of the theatre production
- Attend all design meetings as scheduled by Producer or the Director
- Attend all technical rehearsals and performances as needed
- Maintain the confidentiality of all information and materials related to the Production
- Adhere to professional standards of conduct and behavior at all times

Producer shall be responsible for the following deliverables:

- Provide designer with the necessary scripts, character descriptions, and design guidelines
- Provide designer with a schedule of design meetings and technical rehearsals in advance
- Pay designer the agreed upon compensation in a timely manner
1. Timeline:
The term of this Agreement shall commence on [Start Date] and shall continue until [End Date] or completion of the run of the Production, whichever occurs first. Design meetings and technical rehearsals shall take place from [Design Start Date] to [Design End Date]. Performances shall take place from [Performance Start Date] to [Performance End Date].
2. Compensation:
In consideration for the services to be rendered by designer hereunder, Producer shall pay designer the sum of [Compensation Amount] per week. Payment shall be made on a biweekly basis. designer shall also be entitled to a share of the net profits of the Production, as determined by Producer in its sole discretion.
3. Termination:
This Agreement may be terminated by either party at any time, for any reason, upon written notice to the other party. In the event of termination by Producer, designer shall be entitled to receive compensation for all services rendered up to the date of termination.
4. Confidentiality:
Designer shall maintain the confidentiality of all information and materials related to the Production, including but not limited to scripts, character descriptions, and design plans. designer shall not disclose any such information to any third party without the prior written consent of Producer.
5. Indemnification:
Designer shall indemnify and hold harmless Producer, its affiliates, and their respective officers, directors, employees, and agents, from any and all claims, damages, or expenses arising out of or in connection with designer’s performance of services under this Agreement.
6. Governing Law:
This Agreement shall be governed by and construed in accordance with the laws of the State of [State].
